GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter the "General Terms and Conditions of Sale") govern exclusively the sales made on the website www.douze-paris.fr (hereinafter the "Site") of products offered by Douze Paris (hereinafter "Douze Paris") to buyers (hereinafter the Customer(s)) and specify in particular the conditions of ordering, payment, delivery and handling of any returns of Products ordered by Customers.

Orders that can be placed on the Douze Paris website are strictly reserved for private individuals.

These General Terms and Conditions of Sale are made available to Customers on the Site where they can be directly consulted.

The General Terms and Conditions of Sale are binding on the Customer who declares having read and accepted them by checking the box " I accept the General Terms and Conditions of Sale » before validating their online order.

Any order placed on the Site constitutes the formation of a distance contract between the Customer and Douze Paris, and necessarily implies the irrevocable acceptance by the Customer, without restriction or reservation, of the General Terms and Conditions of Sale applicable at the time of validation of the order on the Site.

Douze Paris reserves the right to modify its General Terms and Conditions of Sale at any time. In the event of modification, the new General Terms and Conditions of Sale will apply only to sales made after the modification. The invalidity of any contractual clause does not invalidate the General Terms and Conditions of Sale as a whole. The temporary or permanent non-application of one or more clauses of the General Terms and Conditions of Sale by Douze Paris shall not constitute a waiver by Douze Paris of its right to apply the other clauses of the General Terms and Conditions of Sale, which shall remain in full force and effect.

1. The Products

In order to allow the Customer to know the Products before placing the order, the website www.douze-paris.fr presents the characteristics of the Products offered for sale.

Photographs illustrate the products offered (hereinafter "the Product(s)") for sale on the Site.

The Customer is advised to refer to the description of each Product to learn about its properties and specific features, particularly regarding the desired characteristics and size. Variations in color and appearance may exist between the image shown on the Website and the actual color of the Product ordered.

Each piece of jewelry purchased comes with tissue paper, a branded rigid box and a guarantee branded by Douze Paris.

For archived parts and prototypes, these are clearance items. We cannot accept refunds or exchanges on this type of product.

1.1. Product Availability

Douze Paris makes every effort to ensure that products appearing as available for sale are actually in stock. However, in the event of a stock shortage or a delay in restocking after final order confirmation, Douze Paris customer service will send an email to the customer informing them of the unavailable products or those whose shipment will be delayed, and in this case, the estimated shipping time. In this case, the customer will have the option to:

  • The customer may cancel their order in whole or in part. In this case, Douze Paris will refund the amount in question within 14 days of receiving written notification of their wish to cancel all or part of the order. These conditions do not apply to custom-made engagement rings or bespoke creations.

  • either to maintain their order and choose to receive the entire order in a single shipment when all the ordered products are available.

Unless otherwise specified, product sales offers presented on the Site are valid as long as the products are listed on the Site and within the limits of available stock or any potential restocking conditions. Indeed, a product may be listed on the Site but no longer be available or awaiting restocking.

The Products listed on the Site indicate their immediate availability or the expected production times if they are not in stock.

The Site reserves the right to remove products from sale at any time.



2. The Commands


2.1. The procedure

The Client must verify that they are using a recommended browser that accepts cookies.

To order our products online, the Customer must:

  • browse the Site's online catalogue

  • Add the products of your choice to your basket. You can access the contents of your basket at any time before confirming your order, to make any changes you wish (including removing selected products or modifying the quantity of selected products).

  • Then, from their shopping cart with a summary of the selected product(s), log in to their account or create one directly from the cart using the login tab at the top of the page. If the customer has already used the services of the Douze Paris online site, they must enter the email address they used to register and their password. All new customers must register on the Site by providing their email address and creating a password.

The customer must click on " order" » to validate your product selection(s).

To finalize the order, the Customer must cumulatively complete the following 2 steps:

  1. tick the box allowing him to confirm his acceptance of all of these General Terms and Conditions of Sale

  2. proceed to online payment of the order according to the chosen payment method.

2.2. Order fulfillment

The data provided by the Customer and recorded by the Website during the ordering process constitutes proof of the transaction between Douze Paris and the Customer. After the Customer validates the order, Douze Paris sends an email to the Customer to inform them that the order has been successfully registered. This email does not constitute order confirmation.

The sale will only be considered final after Douze Paris sends the Customer an email confirming acceptance of the order. However, Douze Paris may be notified by the payment platform that the payment method has been rejected. In this case, despite the confirmation received, the order may not be processed by Douze Paris, which will notify the Customer accordingly.

It is the Customer's responsibility to verify that they have received the email confirming the order or notifying them of the Product's unavailability. If the Customer has not received the email within 48 hours, they should contact the Site's Customer Service at the address contact@douze-paris.fr .

The Customer will be able to track the progress of their order on the Site via their personal account or by contacting customer service directly using the contact details detailed above.

Douze Paris reserves the right to cancel any order from a customer with whom there is a dispute relating to payment for a previous order, or for any other reason at the discretion of Douze Paris: e.g., abnormal nature of the order and, in particular, excessive order volume for an individual, excessively large order made for the same person via different personal accounts.

Orders are not subject to change due to their immediate execution and technical processing.

In the event of a Site malfunction affecting orders or transactions, or a stock shortage of ordered products, Douze Paris reserves the right to cancel the online order placed by the Customer. The Customer will be notified by email or SMS explaining the reason for the cancellation.

3. The Prices

The selling prices for each of the Products are indicated on the Site in € (euros) and are inclusive of all taxes (“TTC”) including French VAT at the rate applicable on the day of the order.

If the VAT rate were to be changed, whether upwards or downwards, this change may be reflected in the price of the Products.

When placing an order, the Customer is asked to ensure that the price of the Products to which he refers corresponds to the price appearing on the updated page of the Site and not on an expired page which he may have accessed through an internet search in so-called "cache" mode.

The selling price of the Product is that in effect on the day the order is placed. Douze Paris reserves the right to modify its prices at any time, while guaranteeing the Customer the application of the price in effect on the day of the order, subject to stock availability.

The selling prices of each of the Products are always understood to be exclusive of delivery charges.

The Customer will be informed before the final registration of their order of the delivery costs (all charges included) related to their order, and payment will be requested from the Customer for the total amount of the purchase indicated on the order validation page.

3. Payment Terms

By validating their order, the Customer acknowledges their obligation to pay for the Product(s) ordered by checking the box " order with obligation to pay "

Payment is made immediately upon order confirmation by the Customer via the chosen payment method. Available payment methods are: Carte Bleue, Visa, Mastercard, and American Express.

4.1. Security

The information provided by the Customer to place their order is used solely within the context of their business relationship with Douze Paris. Under no circumstances will this information be shared with third parties or resold. The Customer's bank details (credit cards) are used only for payment processing with our secure payment partners Stripe and Scalapay; Douze Paris does not retain any of the Customer's banking information.

4.2. Refusal to settle

Douze Paris reserves the right to refuse any suspicious transaction, deleting any order registration, particularly if the quantities of Products ordered are abnormally high.

Douze Paris also reserves the right to refuse payment and thus cancel orders:

  • For a delivery address that is not listed, or to a hotel or post office box,

  • in case of doubt about the validity of the order

  • in case it is impossible to contact the Client.

5. Delivery

5.1 Delivery date

For Products in stock, Douze Paris undertakes to deliver orders within a period not exceeding 14 days from receipt of the order confirmation email sent by Douze Paris.

5.2 Delivery methods

The Products will be delivered by Colissimo, UPS or Chronopost to the address indicated by the Customer when placing their order on the website www.douze-paris.fr

The delivery address used is the one provided by the Customer at the time of ordering. Any change of delivery address requested by the Customer may result in a longer delivery time. If the requested change of delivery address is to an address outside the European Union, the Customer is responsible for all delivery costs, including any customs fees. Douze Paris cannot be held liable for any additional costs.

Except in special cases or if one or more Products are unavailable, the Products ordered will be delivered in a single shipment.

Please note that it is more economical to group all products into a single order. If two or more orders are placed on the same day for the same delivery address, Douze Paris will not be able to combine them, and shipping costs will be charged separately for each order.

If the Products are delivered in several installments by Douze Paris, the latter will assume, where applicable, the additional delivery costs.

5.3. Delivery Delay

If the delivery deadline indicated to the Customer is exceeded for reasons not attributable to the Customer, an unforeseeable and insurmountable event caused by a third party to the contract, or a case of force majeure, the Customer may request cancellation of the sale by registered letter with acknowledgment of receipt or by written notice on another durable medium. To do so, the Customer must formally request, by registered letter with acknowledgment of receipt, that Douze Paris deliver the Product(s) within a reasonable additional period. If Douze Paris fails to deliver within this period, the Customer may send a registered letter with acknowledgment of receipt, which will constitute cancellation of the sale.

The contract will be considered terminated upon receipt by Douze Paris of the letter or written notice informing them of this termination, unless the order has been executed in the meantime.

In the event of termination due to late delivery of the Product(s), Douze Paris undertakes to reimburse the Client for all sums paid, at the latest within 14 (fourteen) days following the date on which the Client terminated the contract.

5.4. Product Receipt

Douze Paris advises the Customer to refuse any damaged package and to notify Customer Service, in writing and in detail, of any issues within 3 days, keeping proof of their written notification. Otherwise, Douze Paris will consider that the Customer has received the products in satisfactory condition.

5.5. Delivery methods and rates

Douze Paris delivers via Colissimo or UPS. Orders are prepared within 24 business hours at our facilities and then handed over to the carrier for shipment to the address chosen by the customer. Delivery times are between 2 and 7 days, depending on the destination. Shipping costs are calculated automatically at checkout based on the destination country; the customer can view this information in their shopping cart.

5.6. Delivery abroad

As orders are shipped from France, no customs duties apply for deliveries within the European Community.

6. Guarantees

6.1 Legal guarantee of conformity for consumer goods

To invoke the legal guarantee of conformity (Article L.217-3 of the Consumer Code), the Customer has one year from the delivery of the goods to take action. The Customer may, where applicable, choose between repair or replacement of the goods, subject to the cost conditions stipulated in Article L.217-9 of the Consumer Code, which states that In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods . However, the seller may refuse to proceed according to the buyer's choice if that choice entails a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. In that case, the seller is obligated to proceed, unless impossible, according to the option not chosen by the buyer. »

In accordance with Article L.217-10 of the same Code, "if repair and replacement of the goods are impossible, the Customer may return the goods and receive a refund of the price or keep the goods and receive a partial refund of the price.

The same option is available to him:

1° If the solution requested, proposed or agreed upon pursuant to Article L. 217-9 cannot be implemented within one month of the buyer's claim;

2° Or if this solution cannot be implemented without major inconvenience to the latter, taking into account the nature of the property and the use he seeks.

However, the sale cannot be rescinded if the non-conformity is minor.

6.2 Legal guarantee against hidden defects for consumer goods

The warranty against hidden defects (article 1641 et seq. of the Civil Code) allows the Customer to be protected against hidden defects in the purchased product which prevent its use or affect it to such an extent that the Customer would not have acquired it or would have paid a lower price, if he had known of them.

The Client has a period of 2 (two) years from the discovery of the defect to take action and benefit from the guarantee, free of charge.

The warranty against hidden defects can be invoked provided that the defect meets the following 3 conditions:

  • To be hidden, that is to say, not apparent at the time of purchase

  • To render the property unfit for its intended use or to greatly diminish its use

  • The defect must exist upon receipt of the purchase. It is the Client's responsibility to prove the existence of the hidden defect.

6.3 Implementation of the guarantee

Any product under warranty that proves to be defective may, at the customer's option:

  • To be replaced, subject to availability, by an identical product;

  • To be repaired depending on the degree of damage to the Product under warranty as well as the possibility of execution and the availability of spare parts.

However, Douze Paris will not be able to accept the Customer's choice if it entails a cost that is clearly disproportionate to the other option, taking into account the value of the Product or the significance of the defect.

The Douze Paris warranty does not cover damage to Products caused by accident, misuse or abuse, modification, attempted repair, negligence following purchase or normal wear and tear.

Douze Paris's warranty on the Products is for a period of one (1) year.

To benefit from the guarantee, the Customer must contact Douze Paris Customer Service by following these steps:

  • Have your order number and the name of the item in question ready (this information is indicated on your purchase invoice);

  • Submit your request for support to Douze Paris Customer Service by email at the following address: contact@douze-paris.fr

To ensure prompt and high-quality processing of the warranty claim, the Customer will provide their contact details, order number and the name of the item concerned, and will describe the problem encountered in as much detail as possible and, if possible, attach a photograph of the Product defect to the email.

Upon receipt of this request, Douze Paris Customer Service will contact the Customer within 48 working hours to indicate the procedure to follow.

In the event of a return of the Product by the Customer under this warranty, it will be the Customer's responsibility to return the Product by registered mail or any other secure means of transport, Douze Paris not being responsible for any damage, loss or theft during return transport.

7. Out-of-Warranty Repair

In the event that the requested repair is not covered by the warranty or if the warranty has expired, Douze Paris offers the Customer (subject to availability of parts) a paid repair.

  • Have your order number and the name of the item in question ready (this information is indicated on your purchase invoice sent by email after the sale and can be found under the My Account > My Orders tab);

  • Submit your request for support to Douze Paris Customer Service by email at the following address: contact@douze-paris.fr

Douze Paris Customer Service will confirm receipt of your personalized quote request within 2 business days. A personalized quote will be sent to you by email within 8 business days of receiving your quote request. For all types of service, the estimated repair time is 15 days.

 

8. Right of Withdrawal

In the event that the ordered product is not suitable for the Customer, Douze Paris grants them a withdrawal period of 14 days following its receipt.

The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and expressly designated by the Customer, takes physical possession of the Product.

The right of withdrawal can be exercised within the indicated period, without having to justify oneself or pay any penalty, by sending, by any written means (mail, email, fax) or via the attached form, one's unambiguous intention to withdraw.

Douze Paris will communicate to the Client, upon receipt of the withdrawal form or the unambiguous declaration expressing his or her wish to withdraw, an acknowledgement of receipt (by email).

It is understood that this right of withdrawal can only be exercised on products that have not yet been used or altered in any way by the Customer. The Product must be returned in perfect condition, in its original packaging, and accompanied by the return slip and the delivery note.

Return shipping costs are the sole responsibility of the customer. Please ensure the jewelry is securely wrapped in tissue paper and secured with tape to prevent it from slipping out of the box. Douze Paris accepts no liability for damage, loss, or theft during return shipping.

Douze Paris undertakes to reimburse the Customer for the amount of the purchased product no later than fourteen days from the date on which Douze Paris was informed of the Customer's decision to withdraw. This undertaking is subject to receipt by Douze Paris of the Products or, at a minimum, proof of shipment that the Customer must send to Douze Paris.

Douze Paris undertakes to issue the refund using the same payment method used by the Customer when placing the order. This is unless the Customer expressly agrees to use a different payment method and provided that the refund does not incur any costs for the Customer.

If the Product is returned after the aforementioned period, the Product will be reshipped at the Customer's expense. After this period, the Product will be retained by Douze Paris.

NB. Engagement rings, custom-made or reworked jewelry, engraved jewelry and fully pavé rings, such as the Iris and Iris Vintage wedding bands, are excluded from the right of withdrawal.

For hygiene reasons, we do not reimburse piercings used as prostheses during our piercing workshops.


9. Intellectual Property

The Customer acknowledges that the Douze Paris Products and distinctive signs (image, photographs, packaging, product name, etc.) are the exclusive property of Douze Paris.

The Client shall refrain from any act of reproduction or use of Product models, packaging, trademarks or distinctive signs, inventions, techniques or know-how used by Douze Paris, as well as any act tending to the appropriation of these elements, whether or not they are subject to protection by Douze Paris by a patent, trademark, registered design or copyright.

10. Responsibility of Twelve Paris

Douze Paris cannot be held liable for non-performance or improper performance of the contract due to the Client's actions, an unforeseeable and insurmountable event caused by a third party to the contract, or a case of force majeure.

11. Dispute Resolution and Applicable Law

Sales concluded with Douze Paris via the website www.douze-paris.fr are subject to French law.

All disputes arising from this contract, concerning its validity, interpretation, performance, termination, consequences and subsequent effects, shall be submitted to the French courts.

12. CNIL Declaration and Personal Data

In accordance with the French Data Protection Act of 6 January 1978, as amended in 2004, this website has been registered with the French Data Protection Authority (CNIL) (www.cnil.fr) under number 2079963 v 0

Douze Paris is responsible for processing the collected data.

The information collected is subject to computer processing intended to allow Douze Paris to process the Client's requests and orders, as well as to offer and inform them about our products.

They are thus used for loyalty, management and statistical analysis purposes.

The Client's personal data is kept for the period strictly necessary to fulfill the purposes for each of the processing operations envisaged by Douze Paris.

In accordance with the provisions of the French Data Protection Act of 6 January 1978 as amended in 2004, the Client has the right to access, modify and delete information concerning him/her that he/she has transmitted on the website www.douze-paris.fr.

SPECIAL CONDITIONS APPLICABLE TO THE CREATION AND MANUFACTURE OF CUSTOM-MADE JEWELRY

You have chosen to entrust Douze Paris with the creation of a custom-made piece of jewelry. We thank you for your trust.

Below you will find all the information relating to the process of creating your jewelry, up to the delivery of the finished product:

  • First meeting (in person or via video conference)

During this first meeting, you will tell us your wishes: style, shape, color(s), size, budget, deadlines… You will also let us know at this time if you already have stones and/or materials that could be used in the planned creation, or if all of these will need to be supplied by Douze Paris.

If during this appointment stones and/or material are handed over to Douze Paris, a dated deposit receipt will be given to you against signature describing the items entrusted for safekeeping, accompanied by a photo.

  • Summary email

Following this initial meeting, Douze Paris will send you a summary email and begin the creative process by producing sketches. Unless you provide written instructions to the contrary within 10 days of receiving this email, the sketch work by Douze Paris will be subject to a flat fee of €180 (including VAT).

  • Sketches

Within a maximum of 28 days from the initial consultation, Douze Paris will send you three sketches of the jewelry design by email, from which you can choose. If none of the sketches completely satisfies you, or if you wish to make adjustments to one of them, Douze Paris will send you a new sketch. If, despite this, you still haven't made your choice, but you maintain your decision to entrust your jewelry creation to Douze Paris, a flat fee of €180 (including VAT) will be charged for the initial sketches.

  • Estimate

Once you have chosen a jewelry design from Douze Paris, they will send you a quote, which you must sign and return to finalize your order. To be valid, the order must be accompanied by a deposit equal to 50% of the total quote amount (including VAT).

  • Stone selection - sourcing

Douze Paris will handle the sourcing of the stone(s) needed to create your piece of jewelry. These (excluding diamonds) will be presented to you for selection at a mutually agreed upon appointment.

Once all the stones have been selected, whether sourced in whole or in part by Douze Paris, the production of your piece of jewelry will begin. This will involve, at Douze Paris's sole discretion, depending in particular on the complexity of the project, either the creation of a 3D model or direct hand-crafted production, for your final approval.

  • Manufacturing lead times

The indicative manufacturing times (excluding the month of August) are 6 to 10 weeks after validation of your final agreement on the shape and composition of your jewelry.

  • Delivery

Once your piece of jewelry is made by Douze Paris, it will either be handed to you personally or delivered to the address you provide. You will be charged the corresponding delivery fees (including insurance).

Custom-made jewelry is neither returnable nor exchangeable . If you wish to make any changes, Douze Paris will provide a new quote.

  • Intellectual property

Douze Paris retains ownership of all intellectual property rights relating to the creation of the jewelry you have entrusted to them, including the sketches (and any modifications thereto) that have been provided to you. Any use or reproduction of these sketches, regardless of the purpose or use, is therefore strictly prohibited.

  • Custody rights

It is your responsibility to retrieve any stones and/or materials you entrusted to Douze Paris for the creation of your jewelry that have not been used, within a maximum of 6 months from the date of deposit. After a period of one year, these materials will be considered abandoned and may be sold by Douze Paris ( law of December 31, 1903 ).



SPECIAL CONDITIONS APPLICABLE TO
JEWELRY PROCESSING

You have chosen to entrust Douze Paris with the transformation of a piece of jewelry that belongs to you. We thank you for your trust.

Below you will find all the information relating to the transformation process of your jewelry, up to the delivery of the finished product:

  • First meeting (in person or via video conference)

During this initial consultation, you will share your preferences with us: type of jewelry, shape, color(s), size, budget, and any deadlines. You will also let us know at this time if you would like Douze Paris to add any stones and/or materials.

When you hand over your jewelry to Douze Paris, you will be given a dated deposit receipt against signature, mentioning the nature of the jewelry entrusted and the number of stones deposited, accompanied by a photo.

  • Expertise in jewelry and gemstones

Following this initial consultation, Douze Paris will conduct an appraisal of the entrusted jewelry, without removing it from its setting. If the appraisal requires removing the jewelry, the associated costs will be invoiced by Douze Paris.

  • Summary email

Once the appraisal of the entrusted jewelry has been completed, Douze Paris will send you a summary email specifying the exact type and number of stones. If applicable, Douze Paris will inform you of any defects in the stones and any damage resulting from their removal.

Douze Paris will then begin its creative process by producing sketches. Unless you provide written instructions to the contrary within 10 days of receiving this email, the work of creating the sketches by Douze Paris will be subject to a flat fee of €180 including VAT.

  • Sketches

Within a maximum of 28 days from the initial consultation, Douze Paris will send you three sketches of the piece of jewelry you wish to have made, via email, from which you can choose. If none of the sketches completely satisfies you, or if you wish to make adjustments to one of them, Douze Paris will send you a new sketch. If, despite this, you still haven't made your choice, but you maintain your decision to entrust your jewelry transformation to Douze Paris, a flat fee of €180 (including VAT) will be charged for the initial sketches.

  • Estimate

Once you have chosen a piece of jewelry from Douze Paris, and before the jewelry entrusted to you is removed from its setting (unless this is required for expert assessment), Douze Paris will send you a quote. You will need to sign and return this quote to finalize your order. To be valid, the order must be accompanied by a deposit equal to 50% of the total quote amount (including VAT).

This quote will not take into account the type of metal and the weight of the jewelry entrusted to us; these will be taken into account in the preparation of the final invoice.

  • Stone selection - sourcing

If necessary, Douze Paris will handle the sourcing of the stone(s) required to transform your piece of jewelry. These (excluding diamonds) will be presented to you for selection at a mutually agreed upon appointment.

Once all the stones have been selected, the production of your piece of jewelry will begin. This will result, at Douze Paris's sole discretion, depending in particular on the complexity of the project, in either the creation of a 3D model or direct manual production, for your final approval.

  • Manufacturing lead times

The indicative manufacturing times (excluding the month of August) are 6 to 10 weeks after validation of your final agreement on the shape and composition of your jewelry.

  • Delivery

Once your piece of jewelry is made by Douze Paris, it will either be handed to you personally or delivered to the address you provide. You will be charged the corresponding delivery fees (including insurance).

Jewelry altered at your request cannot be returned or exchanged . If you wish to make any changes, Douze Paris will provide a new quote.

  • Responsibility

In its capacity as custodian, Douze Paris is not responsible for the loss of the jewelry entrusted to it by fortuitous event.

Douze Paris is only obligated to return the deposited jewelry in the condition it is in at the time of return. Any damage not caused by Douze Paris remains your responsibility.

Douze Paris retains ownership of all intellectual property rights relating to the transformation of the jewelry you have entrusted to them, including the sketches (and any modifications thereto) that have been provided to you. Any use or reproduction of these sketches, regardless of the purpose or use, is therefore strictly prohibited.

  • Custody rights

It is your responsibility to retrieve any stones and/or materials you entrusted to Douze Paris for the transformation of your jewelry that have not been used, within a maximum period of 6 months from the date of deposit. After a period of one year, these items will be considered abandoned and may be sold by Douze Paris ( law of December 31, 1903 ).
