1. The ProductsIn order to allow the Customer to know the Products before placing the order, the Site www.douze-paris.fr presents the characteristics of the Products offered for sale.
Photographs illustrate the products offered (hereinafter “the Product(s)) for sale on the Site.
The Customer is invited to refer to the description of each Product in order to know its properties and particularities, in particular with regard to the desired characteristics and the desired size. Variations in color and appearance may exist between the image presented on the Site and the actual color of the Product ordered.
Each piece of jewelry purchased is accompanied by tissue paper, a rigid branded box and a guarantee signed by Douze Paris.
1.1. Product availability
Douze Paris makes its best efforts to ensure that products appearing as available for sale are actually in stock. However, in the event of a stock shortage or waiting for restocking after final confirmation of the order, Douze Paris customer service will send an e-mail to the Customer to inform them of products that are unavailable or whose shipment will be deferred and in this case, the estimated shipping time. 2.2. Fulfillment of the order
The data communicated by the Customer and recorded by the Site during the order constitute proof of the transaction between Douze Paris and the Customer. After validation of the order by the Customer, Douze Paris sends an email to the Customer to inform them that the order has been registered. This email does not constitute confirmation of the order.
The sale will only be considered final after Douze Paris has sent the Customer confirmation of acceptance of the order by email. Douze Paris may, however, be informed by the payment platform of a rejection of the payment method. In this case, despite the confirmation received, the order may not be executed by Douze Paris who will notify the Customer.
It is up to the Customer to verify that he has received the email confirming the order or informing of the unavailability of the Product. If the Customer has not received the email within 48 hours, it is up to him to contact the Site's Customer Service at the address contact@douze-paris.fr .
The Customer will be able to follow the progress of their order on the Site via their personal account or by directly contacting customer service using the contact details detailed above.
Douze Paris reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order, or for any other reason at the discretion of Douze Paris: e.g.: abnormal nature of the order and , in particular, excessive order volume for an individual, excessively large order made for the same person via different personal accounts.
Orders are not subject to change due to their immediate execution and technical processing.
In the event of a malfunction of the Site having affected orders or transactions, or a stock shortage concerning the products ordered, Douze Paris will have the possibility of canceling the online order placed by the Customer. The latter will be informed by e-mail or SMS to indicate the reason for the cancellation of their order.
3. Prices
The sales prices for each of the Products are indicated on the Site in € (euros) and are inclusive of all taxes (“TTC”), including French VAT at the rate applicable on the day of the order.
If the VAT rate were to be modified, upwards or downwards, this change may be reflected in the price of the Products.
When ordering, the Customer is invited to ensure that the price of the Products to which he refers corresponds to the price appearing on the updated page of the Site and not on an expired page to which he would have accessed by an internet search in mode says “hide”.

3. Payment Terms
By validating his order, the Customer acknowledges his obligation to pay for the Product(s) ordered by checking the box “ order with payment obligation ".
Payment is made immediately on the day the order is validated by the Customer via the chosen payment method. The existing payment methods are: Carte Bleue, Visa, Mastercard and American Express.
4.1. Security
The information transmitted by the Customer to place his order is only used within the framework of his commercial relationship with Douze Paris. Under no circumstances may this information be shared with third parties or resold. The Customer's banking information (bank cards) is only used as part of their payment with our secure payment partners Stripe and Scalapay, Douze Paris not retaining any banking information concerning the Customer.
4.2. Refusal of payment
Douze Paris reserves the right to refuse any suspicious transaction, deleting any order recording, particularly if the quantities of Products ordered are abnormally high.
Douze Paris also reserves the right to refuse payment and thus cancel orders:

5. Delivery
5.1 Delivery date
For Products in stock, Douze Paris undertakes to deliver orders within a period which may not exceed 14 days from receipt of the order confirmation email sent by Douze Paris.
5.2 Delivery terms
The Products will be delivered by Colissimo, UPS or Chronopost to the address indicated by the Customer when ordering on the Site www.douze-paris.fr
The delivery address taken into account is that indicated by the Customer at the time of the order. Any change of delivery address made by the Customer may result in an extension of the delivery time. If the change of delivery address is requested for an address outside the European Union, the delivery costs are entirely the responsibility of the Customer as are any potential customs fees. Douze Paris cannot be held responsible for additional costs.
Except in special cases or unavailability of one or more Products, the Products ordered will be delivered in one go.
Note that it is more interesting to group all the products into a single order. If two or more orders are made on the same day for the same delivery location, Douze Paris will not be able to group them and shipping costs will be invoiced for each of them separately.
If the Products are delivered in several installments by Douze Paris, the latter will assume, where applicable, the additional delivery costs.
5.3. Late delivery
In the event of exceeding the delivery deadline which had been indicated to the Customer which is neither attributable to the Customer, to an unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure, the Customer may request resolution of the sale by registered letter with acknowledgment of receipt or in writing on another durable medium. To do this, he must instruct Douze Paris by registered letter with acknowledgment of receipt to deliver the Product(s) within a reasonable additional period of time. If Douze Paris has not complied within this period, the Client may send a registered letter with acknowledgment of receipt constituting resolution.
The contract will be considered terminated upon receipt by Douze Paris of the letter or writing informing it of this resolution, unless the order has been executed in the meantime.
In the event of resolution due to late delivery of the Product(s), Douze Paris undertakes to reimburse the Customer for all sums paid, at the latest within 14 (fourteen) days following the date on which the Customer terminated the contract. .
5.4. Receipt of products
Douze Paris invites the Customer to refuse any damaged package and to notify Customer Service, in written and detailed manner, of the reservations expressed, within 3 days, retaining proof of their writing. Failing this, Douze paris considers that the Customer has received the products in a completely satisfactory condition.
5.5. Delivery methods and prices
Douze Paris makes deliveries by Colissimo or UPS. The order is prepared within a maximum of 24 working hours in our premises, it is then handed over to the carrier to the location chosen by the Customer. Delivery times are then between 2 and 7 days depending on the location. Delivery rates are calculated automatically when ordering according to the country of destination, the Customer can consult this information in their basket.

5.6. Delivery abroad
As orders are shipped from France, no customs duties apply for deliveries within the European Community.
6. Guarantees
6.1 Legal guarantee of conformity for consumer goods
To act as a legal guarantee of conformity (article L.217-3 of the Consumer Code), the Customer has a period of two years from delivery of the good to act. The Customer may, where applicable, choose between repair or replacement of the goods, subject to the cost conditions provided for by article L.217-9 of the Consumer Code which states that “ In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods . However, the seller may not proceed according to the buyer's choice if this choice results in a cost that is manifestly disproportionate with regard to the other method, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer »
In accordance with article L.217-10 of the same Code, "if repair and replacement of the goods are impossible, the Customer may return the goods and have the price refunded or keep the goods and have part of the price refunded .
The same faculty is open to him:
1° If the solution requested, proposed or agreed pursuant to article L. 217-9 cannot be implemented within one month following the buyer's complaint;
2° Or if this solution cannot be done without major inconvenience for him taking into account the nature of the property and the use he is seeking.
However, the sale cannot be canceled if the lack of conformity is minor.
6.2 Legal guarantee against hidden defects for consumer goods
The guarantee of hidden defects (article 1641 et seq. of the Civil Code) allows the Customer to be protected against hidden defects in the product purchased and which prevent its use or affect it to such an extent that the Customer would not have not acquired or would have given only a lower price, if he had known about them.
The Customer has a period of 2 (two) years from the discovery of the defect to act and benefit from the guarantee, free of charge.
The guarantee for hidden defects can be invoked provided that the defect meets the following 3 conditions:

6.3 Implementation of the guarantee
Any Product under warranty which turns out to be defective may, at the Customer's choice:

Be replaced subject to availability by an identical Product;

Be repaired depending on the degree of damage to the Product under warranty as well as the possibility of execution and the availability of spare parts.
However, Douze Paris will not be able to accept the Customer's choice if it results in a cost that is clearly disproportionate with regard to the other method taking into account the value of the Product or the importance of the defect.
The Douze Paris warranty does not cover damage to Products caused by an accident, misuse or abusive use, modification, attempted repair, negligence following purchase or normal wear and tear.
The Douze Paris guarantee on the Products lasts one (1) year.
To benefit from the guarantee, the Customer must contact Douze Paris Customer Service by following the following steps:

Bring the order number and the name of the item concerned (this information is indicated on your purchase invoice);

In order to ensure rapid and high-quality processing of the warranty request, the Customer will specify his contact details, his order number and the name of the item concerned and will detail as much as possible the problem encountered and, as far as possible, will attach email a photograph of the Product defect.
Upon receipt of this request, Douze Paris Customer Service will contact the Customer within 48 working hours to indicate the procedure to follow.
In the event of return of the Product by the Customer under this guarantee, it will be the responsibility of the Customer to return the Product by registered mail or any other secure mode of transport, Douze Paris not being responsible in the event of damage, loss or of theft during return transport.
7. Out-of-Warranty Repair
In the event that the requested repair is not covered by the warranty or if the warranty has expired, Douze Paris provides the Customer (subject to availability of parts) with a paid repair.

Douze Paris Customer Service will confirm receipt of the personalized quote request within 2 working days. A personalized quote will be communicated to the Customer by email within 8 working days from receipt of the quote request. For all types of support, the repair time is estimated at 15 days.
8. Right of withdrawal
In the event that the ordered product does not suit the Customer, Douze Paris grants him a withdrawal period of 14 days following receipt.
The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and expressly designated by the Customer, takes physical possession of the Product.
The right of withdrawal can be exercised within the period indicated, without having to justify it, or pay a penalty, by sending by any written means (mail, email, fax) or via the attached form, its desire to withdraw, devoid of of ambiguity.

Douze Paris will communicate to the Client, upon receipt of the withdrawal form or the unambiguous declaration expressing its desire to withdraw, an acknowledgment of receipt (by e-mail).
It is understood that this right of withdrawal can only be exercised on products which have not yet been the subject of any use or alteration by the Customer. The Product must be returned in perfect condition, in its original packaging and accompanied by the return slip and the delivery slip.
Return costs are the sole responsibility of the Customer. Be careful to wrap the jewelry in tissue paper with tape to prevent it from slipping out of the box. Douze Paris declines all responsibility in the event of damage, loss or theft during return transport.
Douze Paris undertakes to reimburse the Customer for the amount of the product purchased no later than fourteen days from the date on which Douze Paris was informed of the Customer's decision to withdraw. This commitment is subject to receipt by Douze Paris of the Products or, at a minimum, proof of shipment that the Customer will send to Douze Paris.
Douze Paris undertakes to make the reimbursement using the same means of payment as that used by the Customer when validating the order. Unless expressly agreed by the Customer to use another means of payment and to the extent that reimbursement does not incur costs for the Customer.
If the Product is returned after the aforementioned deadline, the Product will be reshipped at the Customer's expense. After this period, the Product is kept by Douze Paris.
NB. Engagement rings, custom-made or transformed jewelry and fully paved rings, such as the Iris and Iris Vintage Wedding Rings, are excluded from the right of withdrawal. These only give rise to an exchange.
For hygiene reasons, we do not reimburse piercings used as prostheses during our piercing workshops.
9. Intellectual Property
The Customer acknowledges that the Douze Paris Products and the distinctive signs (image, photographs, packaging, product names, etc.) are the exclusive property of Douze Paris.
The Customer refrains from any act of reproduction or use of Product models, packaging, brands or distinctive signs, inventions, techniques or know-how used by Douze Paris, as well as any act tending to the appropriation of these elements, whether or not they are the subject of protection by Douze Paris by a patent, trademark, registered design or model or copyright.
10. Responsibility of Douze Paris
Douze Paris cannot be held liable in the event of non-performance or poor performance of the contract due either to the Customer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
11. Dispute Resolution and Applicable Law
Sales concluded with Douze Paris via the website www.douze-paris.fr are subject to French law.
All disputes to which this contract could give rise, concerning its validity, its interpretation, its execution, its termination, their consequences and their consequences will be submitted to the French courts.
12. CNIL Declaration and Personal Data

SPECIAL CONDITIONS APPLICABLE TO THE CREATION AND MANUFACTURING OF CUSTOM-MADE JEWELRY
You have chosen to entrust Douze Paris with the creation of a tailor-made piece of jewelry. We thank you for the trust you place in us.
Below you will find all the information relating to the process of making your jewelry, until the delivery of the finished product:
- First meeting (physical or by videoconference)
During this first meeting, you let us know your wishes: style, shape, color(s), size, budget, deadlines, etc. You also let us know on this occasion if you already have stones and/or materials that could be used as part of the planned creation, or if all of these will have to be provided by Douze Paris.
If during this meeting, stones and/or materials are handed over to Douze Paris, a dated deposit receipt will be given to you against signature describing the items entrusted to custody, accompanied by a photo.
- Summary email
At the end of this first meeting, Douze Paris will send you a summary email and will begin its creative process by making sketches. Unless there is a written counter-order from you before the expiry of a period of 10 days from receipt of said email, the work of producing the sketches by Douze Paris will be subject to a flat-rate billing of €200 including tax.
- Sketches
Within a maximum period of 28 days from the first meeting, Douze Paris will send you by e-mail three sketches of the jewel, from which you can choose. If none of the sketches completely satisfies you, or if you wish to make adjustments to one of them, Douze Paris will send you a new sketch. If, despite this, your choice is still not made, but you maintain your decision to entrust your jewelry creation to Douze Paris, a flat rate bill of €200 including tax will be sent to you for the first sketches.
- Estimate
Once you have made your choice on the model of jewelry proposed by Douze Paris, it will send you a quote for the production, which it will be up to you, to formalize your order, to return signed. To be valid, the order must be accompanied by payment of a deposit equal to 50% of the amount of the quote including tax.
- Choice of stones - sourcing
Douze Paris will take care of sourcing the stone(s) necessary to make your jewelry. These (excluding diamonds) will be presented to you for selection by you during an appointment to be arranged.
Once all the stones have been selected, whether all or part of them have been sourced by Douze Paris, the production of your jewelry will be launched. This will give rise, at the sole choice of Douze Paris depending in particular on the complexity of the project, to the establishment of a 3D modeling or direct manual production, for definitive validation by you.
- Manufacturing delays
Indicative manufacturing times (except August) are 6 to 10 weeks after validation of your final agreement on the shape and composition of your jewelry.
- Delivery
Once made by Douze Paris, your jewelry will either be handed over to you personally or delivered to the address indicated by you. You will be charged for the corresponding delivery costs (including insurance).
Custom-made jewelry cannot be returned or exchanged . If you wish to make a modification, a new quote will be established for this purpose by Douze Paris.
- Intellectual property
Douze Paris retains ownership of all intellectual attributes relating to the creation of the jewelry that you have entrusted to it, in particular with regard to the sketches (and their possible modifications) which will have been transmitted to you. Any use or reproduction of said sketches, whatever the use and purpose, is therefore strictly prohibited.
- Custody right
It is your responsibility to recover the stones and/or materials that you have entrusted to Douze Paris for the creation of your jewelry and which have not been used, within a maximum period of 6 months from their deposit. At the end of a period of one year, these will be considered as having been abandoned and may be sold by Douze Paris ( law of December 31, 1903 ).
SPECIAL CONDITIONS APPLICABLE TO THE TRANSFORMATION OF JEWELRY
You have chosen to entrust Douze Paris with the transformation of a piece of jewelry that belongs to you. We thank you for the trust you place in us.
Below you will find all the information relating to the transformation process of your jewelry, until the delivery of the finished product:
- First meeting (physical or by videoconference)
During this first meeting, you let us know your wishes: type of jewelry, shape, color(s), size, budget, deadlines, etc. You also let us know on this occasion if you would like stones and/or materials to be added by Douze Paris
When you hand over your jewel(s) to Douze Paris, a dated deposit receipt will be given to you against signature mentioning the nature of the jewel(s) entrusted and the number of stones deposited , accompanied by a photo.
- Expertise in jewelry and stones
At the end of this first meeting, Douze Paris will carry out an assessment of the jewel(s) entrusted, without it(s) being removed. If the expertise requires unscrewing of the jewel(s), the related costs will be invoiced by Douze Paris.
- Summary email
Once the assessment of the entrusted jewel(s) has been carried out, Douze Paris will send you a summary email specifying the exact nature and number of stones. If applicable, Douze Paris will inform you of the defects presented by the said stones, and of any possible deterioration resulting from unpicking.
Douze Paris will then begin its creative process by making sketches. Unless there is a written counter-order from you before the expiry of a period of 10 days from receipt of said email, the work of producing the sketches by Douze Paris will be subject to a flat-rate billing of €200 including tax.
- Sketches
Within a maximum period of 28 days from the first meeting, Douze Paris will send you by e-mail three sketches of the jewelry you wish to make, from which you can choose. If none of the sketches completely satisfies you, or if you wish to make adjustments to one of them, Douze Paris will send you a new sketch. Once your choice has been made on the model of jewelry offered by Douze Paris, and before the entrusted jewelry(s) are removed, unless it has been made imperative for their ) expertise, Douze Paris will send you a production estimate, which it will be up to you, to formalize your order, to return signed. To be valid, the order must be accompanied by payment of a deposit equal to 50% of the amount of the quote including tax.
This quote will not take into account the nature of the metal and the weight of the jewelry(s) entrusted, they will be taken into account in establishing the final invoice.
- Choice of stones - sourcing
If necessary, Douze Paris will be responsible for sourcing the stone(s) necessary for the transformation of your jewelry. These (excluding diamonds) will be presented to you for selection by you during an appointment to be arranged.
Once all the stones have been selected, the production of your jewelry will be launched. This will give rise, at the sole choice of Douze Paris depending in particular on the complexity of the project, to the establishment of a 3D modeling or direct manual production, for final validation by you.

Douze Paris is only required to return the jewelry(s) deposited in the condition they are in at the time of return. Any damage that did not occur due to this remains your responsibility.
- Intellectual property
Douze Paris retains ownership of all intellectual attributes relating to the transformation of the jewelry that you have entrusted to it, in particular with regard to the sketches (and their possible modifications) which will have been transmitted to you. Any use or reproduction of said sketches, whatever the use and purpose, is therefore strictly prohibited.
- Custody right
It is your responsibility to recover the stones and/or materials that you have entrusted to Douze Paris for the transformation of your jewelry and which have not been used, within a maximum period of 6 months from their deposit. At the end of a period of one year, these will be considered as having been abandoned and may be sold by Douze Paris ( law of December 31, 1903 ).
